1.1 The Artist reserves the right to decline commissions, cancel and refund the money for a commission, at any time.

1.2 The final product is strictly for Personal Noncommercial Use ONLY. Rights must be purchased for Commercial Use.

1.3 Always credit and link back to The Artist whenever you post it online.

1.4 The Artist retains all the rights over all the commissioned outputs. Unless the Full Rights to the artwork are purchased.

1.5 The Artist is allowed to display all commissioned outputs and post it online or include it in their portfolio, unless agreed upon with the client.

1.6 The Artist reserves the right to record the creation of the artwork, unless agreed upon with the client.

1.7 The final outputs of the commission MAY NOT be used in any way to be used on or train generative AI.

1.8 Contact should be done through Instagram, Twitter or E-mail.

2.1 Accepted methods of payment: Paypal and Ko-Fi commissions.

2.2 There will be a conversion and platform fee applied on top of the total of the commission (7,42% for PayPal and 12,78% on Ko-Fi).

2.3 Commissions under USD 500 will be paid fully upfront.

2.4 Commissions at 500 USD and above can be paid 50% upfront, and 50% upon completion. That is, however, completely up to the client.

2.5 The value of the commission may be discussed with the client and raised in the following cases:

^{2.5.1 A Design fee will apply for vague/nonexistent image references, or if there is an aspect on the commission that has to be designed by the artist. This will be calculated according to the amount and complexity of designs drafted.}

^{2.5.2 A 25% fee will be applied to private or NDA commissions, as well as Non-Watermarked works.}

3.1 The client will receive updates during the drafting, sketching and base color stages of the commission.

^{3.1.1 During the DRAFTING STAGE the commission can be heavily altered in composition and poses.}

^{3.1.2 During the SKETCHING STAGE the commission can have alterations such as head, hands, arms, etc. positioning, and smaller details.}

^{3.1.3 During the BASE COLOR STAGE, the sketch of the commission can no longer be altered by request of the client, only the colors/color palette.}

3.2 Files will be delivered in a Google Drive folder (PNG and flattened PSD).

3.3 After the conclusion and delivery, 2 revisions will be available,excluding any revisions necessary due to mistakes on the Artist’s part. Any further revisions will cost a total of 5% of the full commission price each.

4.1 The usual time frame for the completion of a commission is 1-2 months depending on complexity.

4.2 A general or set timeline can be decided by the client while negotiating the commission.

4.3 Due to college and other personal obligations, there will be instances where pieces may take longer to be completed, this, however, will be communicated with the client, as well as constantly updated.

4.4 A tight deadline will be subject to a Rush Fee.

You can use and alter the commission is the following ways:

^{Cropping: for avatar, icon, and social media banner use. (w/ proper credit.)}

^{Print it for yourself, and display it in any way you wish to.}

6.1 The commission can be fully refunded up to 3 days after payment is received. After that period, if there is no progress yet made, you can request a refund with a 5% Kill Fee (a fee that compensates the Artist for lost time and administration).

6.2 If the commission has already been started, the value refunded will be proportional to the art's progress + the beforementioned Kill Fee.

6.3 You will be entitled to full refund in case The Artist is unable to provide any progress within a month of payment.

Commercial usage entails any actions that will make a profit out of the artwork, such as:

^{Promotional posts advertising products, events, streams, and similar.}

^{YouTube video thumbnails, Stream layouts/Overlays, and usage in Youtube videos in general.}

^{Reproduction on any type of merch.}

The price and purchase of Commercial or Full Rights may be discussed with the artist before or after the commission is completed and delivered.

8.1 By commissioning the Artist, the client agrees not to issue a chargeback or dispute via PayPal or other payment platforms after the work has been completed and delivered.

8.2 In the event of a chargeback or dispute, the Artist reserves the right to:

^{Blacklist the client from future commissions.}

^{Publicly post proof of the transaction and delivered work (excluding private/NDA commissions).}

^{And pursue legal action if necessary to recover lost funds.}

8.3 All communication and agreements are documented to provide evidence of the client’s acceptance of these terms.

8.4 The client understands that digital goods are non-refundable once delivered and/or significantly worked on, due to their intangible nature.

8.5 Any chargeback made in bad faith will result in the forfeiture of rights to the artwork and may lead to legal action for copyright infringement or theft of services.

1.3 Sempre dê créditos e linke o Artista sempre que postar a arte online.

1.4 O Artista mantém todos os direitos sobre todas as obras comissionadas, a menos que os Direitos Totais da obra sejam comprados.

1.5 O Artista pode exibir todas as obras comissionadas e postá-las online ou incluí-las em seu portfólio, a menos que acordado o contrário com o cliente.

1.6 O Artista reserva o direito de gravar o processo de criação da arte, a menos que acordado o contrário com o cliente.

1.7 Os produtos finais da comissão NÃO PODEM ser usados de nenhuma forma para treinar ou serem utilizados por inteligência artificial generativa.

1.8 O contato deve ser feito por Instagram, Twitter ou E-mail.

2.1 Métodos aceitos de pagamento: PIX.

2.2 Comissões podem ser pagas 50% antecipadamente e 50% na conclusão, conforme escolha do cliente.

2.3 O valor da comissão pode ser discutido com o cliente e aumentado nos seguintes casos:

^{2.3.1 Uma Taxa de Design será aplicada para referências de imagem vagas/inexistentes, ou se algum aspecto da comissão tiver que ser criado pelo artista. O valor será calculado de acordo com a quantidade e complexidade dos designs elaborados.}

^{2.3.2 Uma taxa de 25% será aplicada a comissões privadas, com contrato de confidencialidade (NDA), ou obras sem marca d'água.}

3.1 O cliente receberá atualizações durante as etapas de rascunho, esboço e base de cor da comissão.

^{3.1.1 Durante a ETAPA DE RASCUNHO, a composição e as poses podem ser alteradas livremente.}

^{3.1.2 Durante a ETAPA DE ESBOÇO, é possível alterar a posição da cabeça, mãos, braços, entre outros detalhes menores.}

^{3.1.3 Durante a ETAPA DE BASE DE COR, o esboço não poderá mais ser alterado a pedido do cliente, apenas as cores/paleta de cores.}

3.2 Os arquivos serão entregues em uma pasta do Google Drive (PNG e PSD achatado).

3.3 Após a conclusão e entrega, duas revisões estarão disponíveis (exceto correções de erros do Artista). Revisões adicionais terão custo de 5% do valor total da comissão por cada uma.

4.1 O prazo normal para conclusão de uma comissão é de 1 a 2 meses, dependendo da complexidade.

4.2 Um prazo específico pode ser combinado com o cliente durante a negociação.

4.3 Devido a obrigações pessoais e a faculdade, pode haver atrasos na entrega, que serão comunicados com o cliente com atualizações frequentes.

4.4 Prazos curtos estão sujeitos a uma Taxa de Urgência (Rush Fee).

Você pode usar e modificar a comissão das seguintes maneiras:

^{Cortar a imagem: para avatar, ícone e banner de redes sociais (com crédito adequado).}

^{Imprimir para uso próprio e exibir da maneira que desejar.}

6.1 A comissão pode ser totalmente reembolsada até 3 dias após o pagamento. Após esse período, caso não tenha sido iniciado nenhum progresso, é possível solicitar reembolso com uma Taxa de Cancelamento de 5% (compensação pelo tempo e administração).

6.2 Se a comissão já tiver sido iniciada, o valor reembolsado será proporcional ao progresso feito na arte, acrescido da Taxa de Cancelamento.

6.3 Você terá direito a reembolso total caso o Artista não apresente qualquer progresso dentro de um mês após o pagamento.

Uso comercial se refere a qualquer ação que visa lucrar com a arte, como por exemplo:

^{Postagens promocionais para produtos, eventos, lives e afins.}

^{Yhumbnails de vídeos do YouTube, layouts/overlays de stream, ou uso em vídeos em geral.}

^{Reprodução em qualquer tipo de merchandising.}

^{O valor e a compra dos Direitos Comerciais ou Direitos Totais podem ser discutidos com o artista antes ou depois da conclusão da arte.}

8.1 Ao comissionar o Artista e efetuar o pagamento via Pix, o cliente concorda que não há possibilidade de estorno automático após o início do trabalho, salvo em casos de fraude ou erro reconhecido oficialmente pelo banco.

8.2 O cliente compreende que o Pix é um meio de pagamento instantâneo, direto e irreversível, e que o serviço contratado é um bem digital, não sujeito a reembolso após ser entregue ou iniciado.

8.3 Em caso de tentativa de estorno indevida via banco ou qualquer ação de má-fé, o Artista se reserva o direito de:

^{Bloquear o cliente de futuras comissões.}

^{Tornar pública a prova do pagamento e da entrega (exceto em comissões privadas/NDA).}

^{Buscar medidas legais para a recuperar o valor ou compensação por danos.}
